President Poroshenko Establishes the Higher Intellectual Property Court

On 29 September 2017, the President of Ukraine signed an Ordinance establishing the Higher Intellectual Property Court, which became immediately effective.

The newly established court will resolve trademark, patent, copyright and other IP disputes as a court of first instance. Its judgments can be appealed to the Supreme Court only without any interlocutory appeals.

The Law "On Judicial System and Status of Judges" sets a number of qualification requirements for potential judges. Regarding the Higher Intellectual Property Court, for example, a patent agent with a minimum of five years of professional experience would be eligible to apply for a position on its bench.
